Terms of Service

1. Scope
The following terms and conditions apply to all orders via my online shop.

2. Contractual partner, conclusion of contract
The purchase contract is concluded with Dauner Weinladen.
The presentation of the products in the online shop is not a legally binding offer, but a non-binding online catalog. You can initially add our products to the shopping cart without obligation and correct your entries at any time before sending your binding order by submitting them in the order process and explained correction aids. By clicking the order button you place a binding order for the goods contained in the shopping cart. Confirmation of receipt of your order will be sent by email immediately after the order has been sent. After processing your order, you will receive an invoice with the stated shipping costs and total invoice amount.

3. Contract language, contract text storage
The language available for the conclusion of the contract is German.
We save the contract text and send you the order data and our terms and conditions by email. You can view and download the terms and conditions at any time here on this page. You can view your past orders in our customer login.

4. Terms of delivery
Shipping within Germany without islands after receipt of payment. Only for people over the age of 18. (GTC protection of minors)
In addition to the specified product prices, shipping costs are added.
We pack in 6 and 12 shatterproof wine shipping boxes. The shipping fee is € 6.95 per box.
You basically have the option of:
Collection from Dauner Weinladen, Borngasse 1, 54550 Daun, during the following business hours: Mondays, Tuesdays, Thursdays, Fridays 9:30 a.m. to 6:30 p.m., Wednesdays and Saturdays 9:30 a.m. to 2:00 p.m.
· Within the city of Daun we deliver free of charge from six bottles.
· We deliver free of charge from 24 bottles within a 20 km radius of Daun.
In the case of collection or delivery within Daun / surroundings, we ask you to indicate this when ordering by notifying us. This reduces the total amount by the specified shipping costs. Payment on collection / delivery.
If the vintage of an ordered wine is no longer available, I will deliver the following year.
I do not deliver to packing stations.

5. Payment
The following payment methods are generally available in our shop:
- Payment in advance
If you choose the payment method prepayment, we will give you our bank details and deliver the goods after receipt of payment.
- Cash payment for collection / delivery by car
- For regular customers we deliver on account

6. Retention of title
The goods remain our property until full payment.

7. Warranties and guarantees
Unless otherwise expressly agreed below, the statutory liability for defects applies.
The limitation period for claims for defects is one year from delivery of the goods.
The above restrictions and shortened deadlines do not apply to claims due to damage caused by us, our legal representatives or vicarious agents
In the event of injury to life, limb or health,
· In the event of willful or grossly negligent breach of duty as well as malice,
· In the event of a breach of essential contractual obligations, the fulfillment of which enables the proper execution of the contract in the first place and on the observance of which the contractual partner can regularly rely (cardinal obligations)
· As part of a guarantee promise, if agreed or
· As far as the scope of the Product Liability Act is open.
Information on any additional guarantees that may apply and their exact conditions can be found with the product and on special information pages in the online shop.

8. Liability
We are always liable without limitation for claims due to damage caused by us, our legal representatives or vicarious agents
In the event of injury to life, limb or health,
· In the event of an intentional or grossly negligent breach of duty,
· In the case of a guarantee promise, if agreed, or
· As far as the scope of the Product Liability Act is open.
In the event of a breach of essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on the observance of which the contractual partner can regularly rely on (cardinal obligations) due to slight negligence on the part of us, our legal representatives or vicarious agents, the amount of liability shall be that which was foreseeable at the time the contract was concluded Limited damage, the occurrence of which can typically be expected. In addition, claims for damages are excluded.

9. Dispute settlement
The European Commission provides a platform for online dispute resolution (OS), which you can find here http://ec.europa.eu/consumers/odr/
We are neither obliged nor willing to participate in a dispute settlement procedure before a consumer arbitration board.

10. Protection of minors
The customer hereby confirms when placing an order that he has reached the legal minimum age of 18 years. The supply of alcohol to minors is prohibited under the Youth Protection Act (JUSchG § 9). We therefore only deliver to people who have reached the age of 18. If there are any doubts about the age of majority of the receiving person when delivering the parcel, the driver of the parcel service is obliged to show his identity card. We ask for your understanding.
